Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the DailyFi mobile application and related services (the “Service”), provided by DailyFi, Inc. (“DailyFi,” “we,” “us,” or “our”).

Please read these Terms carefully. By creating an account or using the Service, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years old and able to form a binding contract to use the Service. By using the Service, you represent and warrant that you meet these requirements and that the information you provide is accurate and complete.

2. The Service

DailyFi is a personal budgeting tool that helps you review your spending, track balances, and build money habits through a daily check-in. The Service lets you securely connect your financial accounts so that your transactions and balances can be displayed and organized within the app.

We may add, change, or remove features of the Service at any time. We may also set limits on certain features or restrict access to parts of the Service without notice or liability.

4. Connecting financial accounts

The Service uses Plaid Inc. (“Plaid”) to connect your bank and credit card accounts. When you link an account, you authorize us and Plaid to access and use your financial account information as described in our Privacy Policy and Plaid’s End User Privacy Policy.

Financial data displayed in the Service is provided by your financial institutions through Plaid. We do not control that data and cannot guarantee that it is accurate, complete, or current. You are responsible for verifying any information before relying on it.

5. Not financial advice

DailyFi is a budgeting and organizational tool. It does not provide financial, investment, tax, accounting, or legal advice, and nothing in the Service should be relied on as such. We are not a bank, financial institution, broker, or fiduciary. You are solely responsible for your financial decisions. Consider consulting a qualified professional before making important financial decisions.

The Service, including its software, design, text, and branding, is owned by DailyFi and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal, non-commercial use, subject to these Terms. You retain ownership of the content you create within the app.

8. Third-party services

The Service relies on third-party services, including Plaid and the Apple App Store. Your use of those services may be subject to their own terms and policies. We are not responsible for third-party services and do not endorse them.

9. Disclaimers

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, secure, or that data displayed will be accurate or complete.

10. Limitation of liability

To the maximum extent permitted by law, DailyFi and its officers, directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising out of or related to your use of the Service. Our total liability for any claim related to the Service will not exceed the greater of the amount you paid us in the twelve months before the claim or one hundred U.S. dollars ($100).

You agree to indemnify and hold harmless DailyFi from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your use of the Service, your violation of these Terms, or your violation of any rights of another party.

12. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access to the Service at any time, with or without notice, if you violate these Terms or if we discontinue the Service. Provisions that by their nature should survive termination will survive.

13. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will notify you through the Service or by other appropriate means and update the “Last updated” date above. Your continued use of the Service after the changes take effect means you accept the updated Terms.

14. Governing law

These Terms are governed by the laws of the State of Delaware, without regard to its conflict of laws rules. Any dispute arising out of or relating to these Terms or the Service will be subject to the exclusive jurisdiction of the state and federal courts located in Delaware, unless otherwise required by applicable law.
